ODYSSEY CINEMAS REWARD TERMS

TERMS AND CONDITIONS

Odyssey Cinemas Rewards is another way in which we reward and thank our loyal customers for their business! Odyssey Cinemas Rewards account holders are able to earn and accumulate points that can be redeemed for concession / Box Office / Merchandise rewards dollars at participating Odyssey Cinemas locations.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING, USING, OR OTHERWISE PARTICIPATING IN ODYSSEY CINEMAS REWARDS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. THESE TERMS MAY CHANGE AT ANY TIME WITHOUT NOTICE. YOU SHOULD REVIEW THESE TERMS AND CONDITIONS AND RELATED POLICIES FREQUENTLY IN ORDER TO DETERMINE WHICH OF THESE MAY BE APPLICABLE TO YOU. YOUR CONTINUED PARTICIPATION AFTER ANY NEW TERMS, CONDITIONS OR POLICIES ARE INSTITUTED SIGNIFIES YOUR CONSENT.

Joining Odyssey Cinemas Rewards

To join the Odyssey Cinemas Rewards program ask to be signed up on site at Odyssey Cinemas locations or sign up at www.odysseycinemas.com. Your use of the Reward Account implies your consent to these TERMS & CONDITIONS.

§ Only U.S. residents age 13 or older are eligible to join the Odyssey Cinemas Rewards program. Odyssey Cinemas Rewards is not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and 18, you may participate in Odyssey Cinemas Rewards only under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions.

§ You may only have one (1) Rewards account that is personal to you. Any request to combine member account point values will be denied.

§ There is no membership fee associated with the Odyssey Cinemas Rewards program.

Earning Points

Odyssey Cinemas Rewards members earn points by presenting their card / QR Code / Member Name or logging in to their account prior to making purchases at participating locations or making a purchase online. A member who presents his or her card after a sale has been finalized will not earn points on that completed purchase and no voiding of the transaction will be allowed to circumvent the rule that the account must be associated prior to the sale.

How points are earned, subject to restrictions as stated below:

§ Sign-up Bonus Points. Odyssey Cinemas may offer bonus points for a patron’s first transaction after receiving their card during advertised promotional periods. These bonus points will not apply to previously opened reward accounts.

§ 5% back. By presenting your account prior to the sale, you will earn 5% for each dollar spent at a participating theatre location on:

a. movie ticket purchase(s) at the box office or online

b. food and beverage items purchased at the concession stands

c. brand merchandise

§ Promotional bonus points. Earn bonus points on certain designated purchases, subject to the terms of limited-time promotional opportunities offered by Odyssey Cinemas.

The following restrictions apply to the accumulation of Points:

§ You will only accumulate points upon the redemption of an Odyssey Cinemas gift card when the gift card value is applied to a box office admission or concession stand purchase. The number of points earned will be based on the purchase price of those items. The points are not applied to the purchase of the gift card itself.

§ Your purchase of auditorium rentals, birthday parties, group shows, field trips, catering events, and other similar and discounted events are not qualified purchases therefore no points will be earned for these sales.

§ If you use coupons or other special offers at the time of a qualifying purchase, you will earn points in accordance with the discounted amount actually paid.

Rewards Dollars

Once you earn $5.00, you will automatically receive an account Voucher for (5) Rewards Dollars and your point balance will return to zero (0). You may use your Rewards Dollars by applying your voucher at the time of a kiosk or online purchase or requesting it be applied at the box office or concession stand for the purchase of food, beverage, and merchandise items. Purchases made on secondary point of sale (POS) equipment for purchases of items other than food, beverage, or merchandise items, will not earn Reward Points and the Rewards Dollars redemption will not be allowed.

The following restrictions apply to Reward Dollars:

§ Reward Dollar Vouchers are earned and remain on the customer account until redeemed. At our option, points earned, and that would be used to receive Reward Vouchers, may expire if you do not redeem or earn Reward Dollars (account inactivity) in any rolling 180 day period.

§ You may not use Rewards Dollars towards the charges related to auditorium rentals, group shows, field trips, catering events, or for other similar events.

§ Reward points will not be earned for purchases of alcohol.

§ Reward Dollars may not be used for alcohol purchases.

§ Rewards Dollars may not be used for credit against a previous purchase.

§ Rewards Dollars are non-transferrable and have no cash value.

§ You may incur taxable income in connection with earning and using Rewards Dollars as provided by law.

Disclaimers; Limitations on Liability

PARTICIPATION IN ODYSSEY CINEMAS REWARDS AND RECEIPT OF ANY OF ITS ASSOCIATED BENEFITS IS AT YOUR SOLE RISK. REWARD DOLLARS EARNED AND ANY OTHER BENEFITS THAT MAY BE PROVIDED BY US TO YOU ARE PROVIDED ONLY ON AN "AS IS" AND "AS AVAILABLE" BASIS. ODYSSEY CINEMAS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. EXCEPT AS OTHERWISE PROVIDED BY LAW, ODYSSEY CINEMAS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF ODYSSEY CINEMAS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM (i) THE USE OR THE INABILITY TO USE POINTS AND/OR REWARDS DOLLARS OR PROGRAM BENEFITS; (ii) MESSAGES RECEIVED OR TRANSACTIONS ENTERED VIA THE USE OF THE PROGRAM; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF A MEMBER’S PROGRAM DATA; OR (iv) ANY OTHER MATTER RELATING TO ODYSSEY CINEMAS REWARDS.

Indemnification

You agree to release, indemnify and hold Odyssey Cinemas harmless from all liabilities, claims and expenses, including, without limitation, attorneys' fees, arising out of or in any way related to your breach of these Terms and Conditions. Further, you agree to reimburse Odyssey Cinemas for any Rewards Dollars or rewards benefits that were fraudulently or inappropriately obtained by you in our sole determination.

Amendment to Terms and Conditions

Odyssey Cinemas may amend, modify, or otherwise change these Terms and Conditions at any time without notice or liability, even if the changes affect point and/or Rewards Dollar quantities, values and earning or redemption opportunities, by posting revised Terms and Conditions at www.odysseycinemas.com. Odyssey Cinemas may change Participating Locations at any time and from time to time without notice. You may view the current version of these Terms and Conditions at any time online at www.odysseycinemas.com

Odyssey Cinemas may cancel Odyssey Cinemas Rewards at any time. You will be notified of any such cancellation in the manner provided by applicable law prior to the effective date of the change.

Odyssey Cinemas may terminate your account and/or your participation in Odyssey Cinemas Rewards if we determine in our sole discretion that you have violated these Terms and Conditions, you have more than one (1) account, or that the use of your account is unauthorized, deceptive, fraudulent or otherwise unlawful.

Governing Law

These Terms and Conditions, and the respective rights and obligations of the parties are governed by and will be construed in accordance with the laws of the State of Minnesota.

Miscellaneous.

These Terms and Conditions do not alter in any way the terms or conditions of any other agreement you may have with Odyssey Cinemas for products, services, or otherwise.

Points and Rewards Dollars earned under Odyssey Cinemas Rewards are promotional and have no cash value.
